The Orono Planning Conunission reviewed this application on September 17, <br />2001 and on a vote of 7 to 0 recommended approval of the proposed variances <br />based upon the following findings: <br />A. The structural coverage on the lot is increasing to 2.230 8 s.f (4.9*i) but <br />still well below the allowed 15%. <br />B. The existing residence was built in its present location, prior to current <br />zoning ordinances. <br />C. The adjacent properties are not affected by the roof extension. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City stalT, comments <br />by the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />The City Council finds that the conditions existing on Uiis property arc peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variances would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not memly <br />serve as a convenience to the applicant, but is necessary' to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial <br />property right of the applicant; and would be in keeping with the spirit and <br />intent of the Zoning Code and Comprehensive Plan of the City. <br />CONCLI SIONS, ORDER AND CONDITIONS <br />Based upon the above findings, the Orono City Council hereby grants uficr-lhe- <br />fact variances to Municipal Zoning Code Section 10.27. Subdiv ision 5(B) to allow a side yard <br />setback of 47 where 50’ is required and a front yard setback of 35.5’ where 100’ is required <br />to permit construction of a 3’ roof overhang above the front entrance, subject to the following <br />conditions: <br />Page 2 of 5
