The property is located in the RR-IB, Single Family Rural Residential Zoning <br />District, where 2 acres is the minimum lot urea. The properly consists of <br />approximately l.S acres. <br />The Orono Planning Commission reviewed this application on September 17.2001 <br />and recommended appan al by a \otc of 7 to 0. <br />The Plaruiing Commission made tiic following findings of fact: <br />A. The 1 50* Natural F.n\ ironment lake setback wns adopted after the residence <br />was built. <br />B. Hardcover in the 0-75* setback zone will decrease to 3.622 s.f. (22.25®/o) from <br />4.381 s.f (26.9%). <br />C. 'I he structural coverage on the property will be 4.9“/o, below the allowed <br />15 “/o. <br />D. Encroachment into the average lakeshore setback will not adversely alTcct <br />the neighboring property views. <br />'Hie City Council finds that the conditions c.xisiing on this propert) arc peculiar to <br />it and do not apply generally to other property in this zoning district; that granting <br />the variance will not adversely affect traffic conditions, light, air. nor pose a fire <br />hazard or other danger to neighboring property; would not merely serve as a <br />convenience to the applicants, but is necessary to alleviate a demonstrable hardship <br />or difficulty; is necessary to preserve a substantial property right of the applicant; <br />and would be in keeping with the spirit and intent of the Zoning Code and <br />Comprehensive Plan of the City. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City Staff*, comments by <br />the applicants and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />Page 2 of 5
