A RESOLUTION GR.\NTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.56, SUBDIVISION 16(C)(1), <br />SECTION 10.56, SUBDIVISION 16(C)(6), <br />SECTION 10.56, SUBDIVISION 16(L)(1); <br />FILE NO. 01-2709 <br />WHEREAS. Richard R. Shull and Anne M Shull (hereinafter "the applicants") arc <br />the owner’s of the propcrt>- located at 2285 French Lake Road uithin the Cit>- of Orono (hereinafter <br />"the City") and legally described as follows: <br />Lot 4. Block Land Outlet C. Johnston’s French Lake Second Addition. Hennepin <br />County. Minnesota (hereinafter “the property ”); and <br />WHEREAS, the applicants have applied to the City for a variance to Municipal <br />Zoning Code Section 10.56, Subdivision 16 (CKO to permit structure within 150’ of a Natural <br />Environment Lake. Section 10.56. Subdivision I6(L)(1) to permit 3,622 s.f. (22.25? b) of hardcover <br />in 0-75* setback area where 4,381 s.f. (26.9?o) e.xists and 0 s.f. (0%) is allowed and Section 10.56, <br />Subdivision 16(CH6) to permit the encroachment of 50' and 75' into the average lakeshore setback <br />for construction of a two stall garage to the east end of the residence and a new cntr> wax ox a <br />existing steps. <br />WHEREAS, after due published notice and mailed notice in accordance xxiih <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on September 17.2001. at xvhich time all persons desiring to be <br />heard concerning this application xxerc given the opportunity to .speak thereon. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono. <br />Minnesota; <br />FINDINGS <br />I.
