CITYofORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 5 f> 1 0 <br />1. <br />CONCLUSIONS, ORDER ANT) CONDITIONS <br />Based upon one or more of ihc above findings, the Orono City Council hereby <br />grams a varianre to Municipal Zoning Cod: Sections 10.22, Subdivision 2 and 10.56, <br />Subdivision 16 (L) to permit the construction of a two stor>* addition consiiiuimg additional <br />hardcover in the 75-250’ zone in excess of the 25 So hardcover normally allowed, subject to the <br />following conditions: <br />Prior to fooling inspection for the addition, applicants shall remove landscape bed <br />hardcover as shown on the sketch and li.st attached to this resolution as Exhibit <br />A. Hardcover in the 0-75’ zone shall be limited to 12 s.f. or 0.25e, and in the <br />75-250’ zone shall be limited to 5.770 s.f. or 31.751. Applicants are advised that <br />any future proposals to add hardcover on the property will require a variance <br />application and might be approved only in conjunction with removal of equivalent <br />amounts of pre-e.xisting hardcover. <br />The appUcant shall obtain an after-the-fact building permit for the screen porch, <br />and a construction inspection shall be conducted by the inspection deparuncut. <br />Authorities granted by this variance run with the property not with the applicants, <br />but are permissive only and must be exercised by application for a building <br />permit within one year of the date oi Council approval, or this variance will <br />expire on that date (October 9. 1996). <br />Violation of or non-compliance with any of the terms and conditions of this <br />resolution shall constitute a violation of the zoning code, shall automatically <br />terminate any authority granted herein, and shall be punishable as a misdemeanor. <br />The undersigned applicants have read, understood and hereby agree to the terms <br />of this resolution and on behalf of themselves, their heus, successors and assigns, <br />hereby agree to the recording of this resolution in the chain of title of the <br />property. <br />2. <br />3. <br />4. <br />5. <br />Page 3 of 6
