May 19.2003 <br />6:00 o ’clock p.m. <br />(«7 «03-2893 JOHN AND ROBERTA HENRICH, Conttoaed) <br />Chair Smith indicated that she felt there was significant hardship to support the variance <br />request a: 1 would be comfortable allowing the applicant to work with staff to find <br />ad^tionai removals to get closer to 25%. <br />Bremer deferred to staff to work with tlie applicant to find additional removals, while <br />maintaining safe access for the applicant. <br />Henrich indicated that he would be happy to work with staff to find some additional <br />removals. <br />Mabusth concurred, stating that, in her opinion, there were sufficient or definite hardships <br />to the land to recommend approval of this application. <br />Bremer moved. Zugschwert seconded, to recommend approval of Application 803> <br />2893. John and Roberta Hearicb. 4125 Highwood Road, granting lot width, average <br />lakeshore setback variances, and a variance to allow an accessory structure without a <br />principal structure during construction on the proper!}'; VOTE: Ayes 5. Nays 0. <br />Bremer moved. Zugschwert seconded, to table the variance for hardcover in the 75'* <br />250* setback zone for the purpose of redesign. VOTE: Ayes 5. Nays 0. <br />(«8) 1^03-2894 DOUGLAS AND ROBAN SMITH. 4195 HIGHWOOD ROAD. <br />CONDITIONAL USE PERMIT AND VARIANCE. 11:17-11:25 P.M. <br />Mr. Smith, the applicant, was present. <br />Mabusth explained that the applicant was requesting the following variances to pemiit <br />replacement of existing retaining walls and stairs within 75* of the OlIWL of Lake <br />Minnetonka: <br />1. 524 s.f. (4.6%) hardcover within the 0-75’ setback zone where none is <br />peimitted; <br />2. grading, filling and excavating of more than 10 cubic yards within 75’ of the <br />OHWL where no more than 10 cubic yards is perming; and <br />3. placing fill in a bluff impact zone where no fill is permitted. <br />Mabusth noted that the City Engineer had requested additional information with regard to: <br />1. A detailed plan and profile design, including sections on either side of the <br />stairway and profile showing how plantings will screen the hardcover from the <br />lakeside; <br />2. Calculations of the necessary amount of excavation and fill for the project; and <br />3. A detailed erosion and sediment control plan. <br />PAGE 27 of 39
