The City Council has considered this application in­ <br />cluding the findings and recoanendations of the Planning <br />Conmission, reports by staff and coaaents of the applicant <br />and the effect of the prcpcscd use on the health, safety and <br />welfare of the coanunity. <br />& mm <br />5. The City Council finds that granting a Conditional Use <br />Pernit to allow the construction ot a 40'xl00* greenhouse <br />will r t be detriaental to the health, safety or general <br />uelfar of the public, would not adversely affect light, air <br />nor pc e a fire hazard or other danger to neighboring pro­ <br />perties, nor will it depreciate surrounding property values <br />and the proposed level of use cf the property will be in <br />keeping with the intent and objectives of the Zoning Code <br />and Coaprehensivc Plan of the City. <br />CC.ICLOSIONS, ORDRR AND COitDlTlONS <br />Based upon the above fi-lings, the Orono City Council <br />hereby grants a Conditional Use Percit per Municipal Zoning Code <br />Section 10.20, Subdivision 3 (E) to pernit thu construction of a <br />con.-icrcia 1 greenhouse, subject to the following conditions: <br />1. The greenhouse structure nust reet all Building Code and <br />Fire Code standards, including the 20* setback fron other <br />greenhouse's if no l-hour firewall is provided. <br />2. The structure shall be set back the sane distance fren <br />the east ride lot line as the existing greenhouses <br />(approxioately 2S'I. <br />3. In granting this conditional use pernit, the Council <br />recognizes that this lot is 4.6 acres in area in rhe RR-IA <br />f--acrc zoning district, and grants an approval for the <br />substandard lot size. <br />iiB 4. There shall be no further retail sales activity on the <br />property. <br />€. If the existing septic systen, at sore future time fails <br />to function satisfactorily, the conditional use shall ccaso <br />until the systea is repaired. <br />7. Violation of or non-conpliance with any of the items and <br />conditions of this resolution shall constitute a violation <br />of the Zoning Code, shall automatically terminate any <br />authority granted herein, and shall be punishable as a <br />misdemeanor. <br />8.
