City of OROIVO <br />RESOLUTION OF THE CITV COUNCIL <br />NO. r>93_________ <br />d) The property is 4.6 acres in area in this S-acre <br />zoning district. <br />e) The new greenhouse will be located 25 feet from the <br />side property line, in conformity with the existing <br />greenhouse structures. <br />f) The City has no complaints on file regarding the <br />use of this property for a cor.-icrcial greenhouse opera ­ <br />tion. <br />4. The City Council has considered this application in­ <br />cluding the findings and recommendations of the Planning <br />Comnission, reports by staff and comments of the applicant <br />and the effect of the proposed use on the health, safety and <br />welfare of the community. <br />5. The City Council finds that granting a Conditional Use <br />Permit to allow the construction ot a 40 ’xl00* greenhouse <br />will r t be detrimental to the health, safety or general <br />uelfar of the public, would not adversely affect light, air <br />nor pc e a fire hazard or other danger to neighboring pro ­ <br />perties, nor will it depreciate surrounding property values <br />and the proposed level of use cf the property will be in <br />keeping with the intent and objectives of the Zoning Code <br />and Comprehensive Plan of the City. <br />CC.JCLOSIONS, ORORR AND CONDITIONS <br />Based upon the above fi'Jings, the Orono City Council <br />hereby grants a Conditional Use Permit per Kunicipal Zoning Code <br />Section 10.20, Subdivision 3 IE) to permit thu construction of a <br />ccrmercial greenhouse, subject to the following conditions: <br />1. The greenhouse structure must meet all Building C'sdc and <br />Fire Code standards, including the 20' setback from other <br />greenhouse's if no 1-hour firewall is provided. <br />2. The structure shall tc set tack the same distance from <br />the east ride lot lino as the existing greenhouses <br />(approximately 25*). <br />3. In granting this conditional use permit, the Council <br />recognizes that this lot is 4.6 acres in area in *ho RR-IA <br />5-acrc zoning district, and grants an approval for the <br />substandard lot size. <br />4. The applicant is placcu on notice that any future addi ­ <br />tional gncnhousc construction or expansion will require a <br />new co.nditional use permit. <br />Page 2 of 4
