The Planning Commission reviewed this application on May 21. 2001 and <br />recommended by a unanimous vote of4 to 0 '^commended approval of a conditional <br />use permit and variances. <br />The Planning Commission made the follow ing findings of fact: <br />A.The guest house will not exceed the 2 acre per ’’dwelling usiir density for <br />properties in the RR-IB zoning district <br />B. <br />C. <br />The guest house meets all required principal building setbacks. <br />An existing guest house will be removed prior to construction of the new <br />guest house. <br />A septic system was replaced that is designed to handle the wastewater for <br />both the principal residence and guest house. <br />The hardship supporting allowing an accessory structure nearer the front lot <br />line than die principal structure is the existing layout of buildings and <br />driveways on the site and the desire to provide sufficient landscape buffers <br />around the guest house. >\liile it could be moved to meet the principal <br />structure setback, that would place it directly adjacent to the driveways with <br />less ability for landsc^ng. <br />The justification for allowing the second oversize accessory structure is that <br />detaching the garage would meet the letter of the code but would result in <br />greater visual impacts due to a less compact guesthouse/garage combination. <br />1 he City Council finds that gianting a conditional use permit to allow a guest house <br />w ill not be detrimental to the health, safety or general welfare of the public, would <br />not adversely affect light, air nor pose a fire hazard or other danger to neighboring <br />properties, nor will its use depreciate surrounding property s-alues and that the <br />proposed level of use of the property will be in keeping with the intent and objectives <br />of the Zoning Code and Comprehensive Plan of the City. <br />Page 2 of 7
