I <br />; •! <br />O <br />occupants in residence of Lots One (1) and Two (2) <br />of Block Three (3), Partenwood Addition, and such <br />docks or facilities for docking may not under any <br />circumstances be used, loaned or made available to <br />any boats owned by or used by any other persons <br />other than those who are either the owners of or in <br />residence at Lots One (1) and Two (2), Block Three <br />(3), Partenwood Addition. <br />F.There shall not, at any time, be kept at Out-Lot A <br />more than two watercraft by any one owner or resident, <br />and no watercraft, of any kind, in excess of twenty- <br />three (23) feet in length shall be moored, stored, <br />or kept at the dock maintained on Out-Lot A. ' <br />G.It is also intended that all of the other conditions, <br />restrictions, and limitations with respect to type, <br />placement, and color of docks, boats, watercraft, <br />etc. shall apply to Out-Lot ^ the same as they apply <br />to all other lots in the Partenwood Addition; except <br />that, in the case of conflict the provisions of this <br />Section IV shall prevail. <br />H. A small sign designating Out-Lot A as private property <br />shall be permitted upon said property. <br />It is the overriding intention of the declarants herein <br />that Out-Lot A is intended to serve the purpose of pro <br />viding lake access for the owner or resident of Lots One <br />(1) and Two (2), Block Three (3) of Partenwood Addition, <br />and that any use of Out-Lot A must be consistent with <br />the residential character of the Partenwood area, and it <br />is intended that the use of Out-Lot A shall be a more re <br />strictive use than that available to the other lots with <br />in the area. <br />It is also intended that Out-Lot A shall forever be kept, <br />maintained and used only for the purposes outlined here <br />in. Any violation of the provisions, conditions, or re <br />strictions contained herein shall warrant the declarants <br />or any other lot owner to apply to any court of law or <br />equity having jurisdiction thereof for an injunction or <br />proper relief in order to enforce same in the court, and, <br />in its descretion, may award the plaintiff his court costs <br />and reasonable attorneys fees. No delay on the part of <br />the declarants or any other person in the exercising of <br />any right, power or rrmedy contained herein shall be con <br />strued as a waiver thereof or an acquiescence therein. <br />Various rights and remedies of all persons hereunder shall <br />be cumulative and the declarants or any other property <br />owner may use any or all of said rights without in any way <br />affecting the ability of the declarant or any other pro <br />perty owner to use or rely upon or enforce any other right. <br />i <br />- 14 -
