m <br />>4. <br />e <br />MINUTES OF A PLANNING COMMISSION MEETING HELD ON JULY 10, 1978 <br />The Orono Planning Commission met on the above <br />date with the following members present: Hurr, <br />acting Chairwoman, McDonald, Wilson and Hannah. <br />Tom Jacobs represented the City staff. <br />Hurr announced this was the time and place for a <br />Public Information Meeting on Edward lfahoney*s <br />Subdivision. Wilson stated that he would step <br />down on this item as his firm represents the <br />applicant. Tom Jacobs explained the request <br />and stated he had an Affidavit of Publication <br />and Certificate of Mailing. Mr. Mahoney, the <br />applicant, and Mr. Brustad, one of the owners <br />of the subject property, were present. Present <br />from the public were Mr. Gerald Hendrickson, <br />2705 Pheasant Road, and Mrs. Henri Jacob, <br />2725 Shadywood Road. They came to the meeting <br />to see what the exact proposal was and had <br />no objections. Mr. Mahoney and Mr. Brustad <br />explained that there are ten people who have <br />an interest in the subject property (Lots 1, <br />5, 6, 8, Part 10, 15, 16, 17, 18 and 24) all <br />have present dockf> and bought the property <br />to maintain the lake access they have used for <br />years and to insure that Lot 14 was left in <br />its present state. Hannah motioned that the <br />Planning Commission table this request pending <br />proposal review by the City attorney regarding <br />legality of lake rights, but if approved, an <br />easement over the wetlands on the island would <br />be required. Motion seconded by McDonald. <br />Vote: Ayes (3), Abstained (1) Wilson. <br />Motion passed. <br />Hurr announced this was the time and place for a <br />Public Information Meeting on Dennis Kumlin <br />Subdivision. Tom Jacobs explained the request <br />and stated he had the Affidavit of Publication <br />and Certificate of Mailing. Mr. Kumlin was <br />present but there was no public present for <br />this item. All setback requirements are met. <br />Hannah made a motion to approve this subdivision <br />as shown on survey dated 6/20/78 conditioned <br />upon payment of park dedication fee and <br />satisfactory testing of existing septic system. <br />Motion seconded by Wilson.
