Commissioner Hurr seconded, a motion <br />to recommend approval of the subdivision request <br />by Sidney Rebers based on the following: <br />SIDNEY REBERS <br />#308 <br />(con* t) <br />(1) <br />'V <br />(2) <br />Tlie applicant submit utility and drainage <br />easements which are to be approved by the <br />City Engineer; and <br />Lot 1, Block 1 meet the 20,000 sq. ft. <br />minimum lot area requirement and that the lot <br />meet all other minimum requirements of the <br />B-1 Zoning Ordinance; and <br />No building permit could be issued until the <br />issue of access onto State property is <br />resolved; and <br />A municipal sewer line availability is resolved; and <br />A current title opinion is addressed to the <br />City and approved by the City Attorney; and <br />No park dedication fee be required on the <br />residential part of the property. <br />Motion - Ayes (6); Nays - (0). The motion passed. <br />Mr. William Hooper, 15300 B Place, was present. <br />The Zoning Administrator stated this is a very <br />substandard lot. He pointed out on the map the <br />proposed lot. He explained this property has been <br />assessed for sewer. <br />Mr, Hooper stated there is a natural drainage <br />through the lot and he expressed concern that if <br />a house is built on the lot there would be no <br />place for the drainage to go. <br />The Zoning Administrator stated this lot could <br />be swailed along the 60 ft. right-of-way. <br />Mayor Van Nest commented he had talked with <br />Mr. Wisocki and it seems this is an unbuildable <br />lot. <br />Mr. Hooper stated he wanted to buy the property <br />to keep it as an undeveloped lot. He added that <br />he did not see how a building could be allowed <br />on this lot with so many variances and since there <br />is water on the lot now. <br />Commissioner Frahm moved. Commissioner Hammerel <br />seconded, a motion to recommend denial of the request <br />for the following lot area and width variances: <br />ARTHUR HEINTZ <br />1565 ORCHARD BEACH RD. <br />VARIANCE-LOT AREA & <br />WIDTH <br />#345
