Section 10.22, Subdivision 1 (B) and Section 10.56, Subdivision 16 (C) (6): To permit an <br />encroachment into the average lakeshore setback. The total encroachment is approximately 42’ <br />for the new residence and 62’ for the lakeside pool. <br />2. Section 10.03, Subdivision 19: Conditional Use Permit: Land alteration of greater than 500 <br />cubic yards. The total fill to be brought onto the site is approximately 2,360 cubic yards. <br />Application Summary: The applicant is requesting an average lakeshore setback variance and a <br />conditional use permit for land alteration to construct a new residence on the property. <br />Discuuion: <br />The existing residence was built in 1967 and has been demolished. Currently the property is <br />vacant. The proposed location of the new residence is further back on the lot than the old <br />residence. However, there is an existing sewer easement and sewer line which prohibits the new <br />residence to be any further back on the lot towards the road. The proposed residence will <br />encroach 42' and the pool will encroach 62’ into the average lakeshore setback. ' <br />The property and adjacent properties are heavily wooded and at different elevations. The <br />topographic map indicates the elevation change from the north to the south of the property. <br />Conditional Use Permit for land alteration: <br />The property owner has requested a conditional use permit to permit land alteration on the <br />property over 500 cubic yards. The proposal indicates approximately 2,360 cubic yards of fill <br />will be brought onto the site. The fill will be used to create a level area to locate the house, <br />provide good drainage and create access to the site for motor vehicles. <br />Average Lakeshore Setback: <br />The proposed residence encroaches 42' and the lakeside pool encroaches 62’ into the average
