'I <br />7. <br />8) <br />Due to the Phasing of the project and the resultant lengthy period of time the <br />site will be under construction, the Developer shall as a condition of the PUD <br />No. 4 Agreement provide an escrow (amount to be determined) to cover the <br />inspection costs of ongoing erosion control inspections. <br />The Developer shall obtain all necessary permits (including but not limited <br />to NPDES, MCWD and MnDOT permits) from the appropriate agencies for <br />erosion control prior to commencing excavation on the site. <br />In the event that the Developer ’s NPDES permit requires a Best Management <br />Practices Plan, such plan shall be submitted to the City prior to commencing <br />excavation on the site. <br />The construction limits shall be clearly marked with adequate fencing to <br />prevent any construction damage or disturbance of any trees and vegetation <br />outside of the construction limits area Prior to commencing excavation <br />on the site. Developer shall identify trees to be preserved, shall mark them on <br />a site plan, and shall take extraordinary measures such as fencing, signage, <br />etc. to ensure they arc not disturbed. <br />Other General Conditions <br />Monument signs as depicted in Sheets___may be provided by the developer <br />at each entrance to the RPUD development site. The signage shall be limited <br />to a development name and/or logo and street address on the monument signs. <br />Any changes to the final design/matcriids of monument signage from those <br />shown on the approved plans shall be subject to approval by the City Council. <br />Any design, material or specification revisions from the approved plans <br />involving streets, utilities, storm sewer facilities, grading or the regional pond <br />shall be subject to approval by the City Engineer prior to implementation of <br />such changes. <br />Any design, material or specification revisions from the approved plans <br />involving dwelling unit design guidelines, architectural styles, building <br />location, site landscaping, and other approved/required site amenities, shall <br />be subject to approval by the Planning Director and may be subject to review <br />and ^roval by the City Council at the discretion of the Planning Director. <br />Page 11 of 17
