'r ij-i- <br />fi) <br />i) <br />The bcmi along the Public Works site cast boundary may be extended <br />eastward as shown on Sheet_____to assist in establishing a buffer to the <br />LoAs; however, any buffer walls, plantings or other improvements shall be <br />located on the LoAs site as shown in the approved General Development Plan. <br />The Developer shall take extraordinary elTorts to minimi/.e impacts on <br />existing vegetation and enhance screening and buffering in the area northwest <br />of the LoAs west building. The City’s Public Works operation may be a 24- <br />hour operation dependent on weather and other emergency situations. A <br />disclosure regarding the LoAs buildings proximity to Public Works shall be <br />required of LoAs buyers to help limit the expected complaints about City <br />activity and noise from the Public Works site. <br />All residential buildings including the LoAs shall have pitched roofs as shown <br />on Sheet___ to maintain a rural residential character. Roofs for the LoAs <br />units shall be low-pitched rather than steeply pitched to decrease the impact <br />of excess building height. <br />Developer shall submit proposed conditions for development of the <br />commercial outlols to maintain the natural amenity values of the pond and <br />protect the perimeter of the pond from encroachment by commercial <br />development. <br />Final landscaping plans shall be subject to the recommendations of Wallace <br />Case as enumerated in his letter dated 11/6/02. The pertinent Homeowners <br />Assoeiation(s) shall be responsible for pennanent maintenance of landscaping <br />per the Landscaping provisions of the RPUD District. As a condition of the <br />PUD No. 4 Agreement, Developer shall provide landscape pcrfomiance <br />security as required in the RPUD District standards. <br />j) The follow ing variance to the RPUD development standards is hereby granted: <br />Building height variance for LoAs building from 30' to 38 ’ defined <br />height (measured from final average grade at high side). <br />P«ge6of 17 <br />V-’ <br />dsiM
