M2-2789/02-2840 <br />December 6,2002 <br />Pages <br />Staff Recommendation <br />Because the Developer has requested final General Development Plan Approval prior to MCWD <br />approvals, which suggests final action may be premature. Council may wish to consider these <br />options. Note that as drafted, the resolution contains statements which will not be valid until future <br />actions take place or until final plans are found acceptable. Staff would be most comfortable with <br />Option 3, although that may not meet with the wishes of the Developer. <br />Option 1.Adopt the Draft Resolution and Rezoning Ordinance subject to MCWD approval, and <br />if significant changes result from MCWD action, it would come back to Council for <br />further review. Staff would fill in the blanks as engineering issues get resolved and <br />final plans are found acceptable. <br />Option 2.Conceptually approve the Draft Resolution and Rezoning Ordinance, with final <br />adoption of withheld until MCWD approval is gained by applicant and engineering <br />issues have been completely addressed. <br />Option 3.Table formal action until MCWD approval is complete and all issues have been <br />addressed. <br />Options 2 and 3 require further extension of the 60^ay review period, which currently only <br />extends to December 10,2002. <br />COUNCIL ACTION REQUESTED <br />Take formal action regarding the fees issue. <br />Take formal action regarding one of the 3 options of action noted above.
