r <br />1. <br />2. <br />3. <br />4. <br />5. <br />FINDINGS <br />This application was reviewed as Zoning File #02-2823. <br />Ilie property is located in the I.R-IC Zoning District where .5 acre is the minimum <br />required lot area. <br />The Orono Planning Commission reviewed this appi ication on October 21,2002 and <br />recommended approval of the proposed variance based upon the following findings: <br />A. 1 he deck as proposed will not obstruct neighboring views. <br />U. The deck will be replacing an e.xisting deck of the same si/.e. (300 s.f.) <br />C. The patio doors need a means to exit the residence. <br />D.The hardcover in the 75-250’ setback zone will decrease to 3,148 s.f. (33%) <br />by removing a portion of the driveway. <br />H. 1 .ot coverage by structures will be limited to 2,360 s.f. (22.1 %). <br />F.The side setback variance will have no negative impacts on the adjacent <br />property. <br />I he City Council finds that the conditions existing on this property arc peculiar to it <br />and do not apply generally to other property in this zoning district: that granting the <br />variance will not adversely afiect tralTic conditions, light, air. nor pose a fire hazard <br />or other danger to neighboring property; would not merely serve as a convenience to <br />the applicant, but is necessary to alleviate a demonstrable hardship or dilllculty; is <br />necessary to pre.serve a substantial property right of the applicant; and would be in <br />keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the <br />City. <br />I he City Council has considered this application including the findings and <br />recommendations ol the Planning Commission, repi>rts by City Staff, comments by <br />the applicant and the effect of the proposed variances on the health, safety and <br />welfare of the community. <br />2 of 6 <br />f <br />f <br />f <br />1
