A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 14(C), <br />SECTION 10.22, SUBDIVISION 1(B), <br />SECTION 10.56, SUBDIVISION 16 (C)(6), <br />SECTION 10.22, SUBDIVISION 2 AND <br />SECTION 10.56, SUBDIVISION 16(LK2); AND <br />SECTION 10.25, SUBDIVISION 6(B) <br />FILE NO. 02-2823 <br />WHEREAS, Ronald Cloud, (hereinafter "the applicant") is the owner of the property <br />located at 3460 North Shore Drive within the City of Orono (hereinafter "the City") and legally <br />described as follows: <br />That part of the Westerly I lalf of Lot 19, Lydiard's Park Lake Minnetonka, according <br />to the recorded plat thereof, Hennepin County, Minnesota, lying southerly of the <br />westerly extension of the south line of Birch Lane, (hereinafter “the property"); and <br />WHEREAS, the applicants have applied to the City for variances to Municipal <br />Zoning Code Section 1 0.03,Siibdivision 1 4(C) to allow 2,283 s.f. (22.1 %) lot coverage by structures <br />where 1,600.95 s.f. (15%) is allowed. Section 10.22, Subdivision 1(B) and Section 10.56. <br />Subdivision 16 (CK6) to allow encroachment of 19' into the average lakeshorc setback. Section <br />10.22, Subdivision 2 and Section 10.56, Subdivision 16(L)(2)to allow 3,228 s.f. (34%) hardcover in <br />the 75-250’ lakeshore setback where 4,089 s.f. (43%) hardcover exists and 2.369.5 s.f. (25%) is <br />allowed. Section 10.25, Subdivision 6(B) to allow a side yard setback of 7.5' where 10' is required <br />to permit replacement of a lakeside deck and stairway; and <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on October 21. 2002, at which time all persons desiring to be <br />heard concerning this application were given the opportunity to speak thereon. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />lof6 <br />-'J
