A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 9 (A) AND (D); <br />AND SECTION 10.27, SUBDIVISION 5 (B) <br />FILE NO.02-2835 <br />WHEREAS, Thomas Frederick Adams, (hereinafter "the applicant") is the owner of <br />the property located at 500 Orchard Park Road within the City of Orono (hereinafter "the City") and <br />legally described as follows: <br />Lot 11, Orchard Park, Hennepin County, Minnesota, (hereinafter “the property*); and <br />WHEREAS, the applicant has applied to the City for a variance to Municipal Zoning <br />Code Section 10.03, Subdivision 9 (A) and (D) to permit an accessory building to remain on the <br />property following removal of the principal building and to permit the building to be located 167 ’ <br />from the front property line, closer to the front property line than the principal building, and Section <br />10.27, Subdivision 5 (B) to permit new construction on a lot containing 4.0 acres exclusive of <br />wetlands in the RR-IA district where 5.0 acres is required. <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on October 21, 2002, at which time ail persons desiring to be <br />heard concerning this application were given the opportunity to speak thereon. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono. <br />FINDINGS <br />1. <br />2. <br />This application was reviewed as Zoning File #02-2835. <br />The property is located in the RR-1A Zoning District, where 5 acre is the minimum <br />required lot area. <br />3.The Orono Planning Commission reviewed this application on October 21,2002 and <br />recommended approval of the proposed variance based upon the following findings; <br />Page I of 6
