PlanniDg Commission Recommendation: <br />The Planning Commission recommended approval by a vote of 7 to 0 to permit use of the <br />building as a resale retail business similar to the existing furniture store, and approves a <br />commecpial site plan for alterations to the parking lot, subject to the following conditions: <br />I.A silt fence or straw bales shall be placed at the base of the slope where the new parking <br />lot was installed for the purposes of protecting the wetland from sediment and erosion <br />from the parking area. <br />2. Topsoil shall be placed on the existing slope and the slope seeded/sodded. <br />3.A wetland delineation shall be completed next spring to determine the wetland boundary <br />and if any encroachment of the wetland or 26 ’ buffer has occurred. <br />4.The parking surface shall be finished to leave a S’ setback to the west property line. <br />Concrete curb and gutter shall be installed to the specifications set by the City Engineer. <br />5.The plans for curb and gutter with a catch basin that will collect sediment from the <br />parking lot shall be reviewed and approved by the City Engineer. <br />6.Plans shall be sent to the MCWD for their review. Any MCWD permits shall be issued <br />prior to any construction or reconstruction work to the parking lot. <br />7. <br />8. <br />The Fire Marshal shall shall approve any plans to install posts to protect the hydrant. <br />The parking lot shall be striped for 13 - 9’ X 20’ spaces, including one handicap <br />accessible space. <br />9.The City of Orono will enter into a Development Agreement with the applicants. The <br />improvements will require a letter of credit for 150% of the estimated costs of the <br />improvements. A letter of credit will allow the City to draw funds to complete any <br />improvements should they not be completed. <br />Since the applicants will not take ownership of the property until mid-November much of the <br />above stated work will not be completed until after occupancy of the building and some items <br />might not be completed until spring, 2003. The applicant ’s have expressed a willingness to do all <br />the above improvements to the property. <br />Staff Recommendation: <br />Staff recommends approval of the application per the conditions as noted above in the Planning <br />Commission recommendation. <br />COUNCIL ACTION REQUESTED <br />Motion to approve use of the property for a resale retail operation for “Hope Chest for Breast <br />Cancer” finding the use is substantially similar to uses permitted in the district and to approve the <br />commercial site plan for changes to the existing parking lot. <br />I <br />0 <br />♦
