Finding of Similar Use: The B-S zoning district does not <br />specifically list furniture store as either a permitted or conditional use. The zoning code does <br />give the Planning Commission and City Council the authority to interpret when a proposed use is <br />substantially similar to other uses in a specific zoning district. 2. The second part of this <br />application is the commercial site plan review . <br />The applicant, Barbara Hensley, intends to purchase the property at 3850 Shoreline Drive which <br />is currently operated as “Bay Furniture.” The applicant intends to operate an upscale resale store <br />called “Hope Chest foi Breast Cancer”. The proposed business will continue to sell furniture, <br />antiques, crystal/china, jewelry and home accessories such as lamps, pictures and rugs. There <br />will be a limited amount of clothing and accessories. There will also be a section devoted to gifts <br />for women with breast cancer and books, supplies, etc. regarding breast cancer. The proceeds of <br />“Hope Chest for Breast Cancer” will go to organizations dedicated to breast cancer research, <br />education and care for the under-served (limited or no health insurance). <br />The property is zoned B-S, Limited Neighborhood business District. A furniture store is not <br />listed in the B-S district as either a permitted or conditional use. In April 1986, the City Council <br />determined that the furniture store was compatible with the other uses in the zoning district and <br />would operate substantially similar to a “gallery”. In October 1986, the City Council approved <br />the commercial site plan for the furniture store. Again in June 1998, the City Council approved <br />the commercial site plan for the current furniture store. <br />Ms. Hensley is asking for the same consideration that was granted, noting “Hope Chest for Breast <br />Can''"- ” is compatible w ith the other uses in the zoning district and would operate substantially <br />similar to a “gallery'” and furniture store (as the property has functioned since 1987). “Hope Chest <br />for Breast Cancer” is very similar in use to the furniture sales use currently in the building, the <br />only difference being resale of “pre-owned” furniture and accessories versus sale of new furniture <br />and accessories.
