First Draftl0/2S/02 <br />CITY OF ORONO <br />HENNEPIN COUNTY, MINESOTA <br />PLANNED UNIT DEVELOPMENT NO. 3 AGREEMENT <br />FOR MEDICAL OFFICE BUILDING <br />AT 2745-2765 KELLEY PARKWAY <br />DEVELOPER: PROFESS. lONAL PROPERTIES OF ORONO, INC <br />THIS AGREEMENT, made and entered into this___day of 2002, by <br />tmd between the City of Orono, a municipal corporation organized and existing under the laws of <br />the State of Minnesota (hereinaAer called “City”), and Professional Properties of Orono, Inc., a <br />Minnesota Corporation, its heirs, successors and assigns (hereinaAer called “Developer ”). <br />WITNESSETH: <br />WHEREAS, the Developer has made application to the City Council for approval of a <br />Planned Unit Development rezoning application (PUD) including a commercial site plan review, for <br />the purpose of developing a 16,000 s.f. medical office building on property located at 2745-2765 <br />Kelley Parkway; and <br />WHEREAS, on September 9, 2002 the City Council granted Concept Plan Approval for <br />development of a 16,000 s.f. medical office building (the “Medical Office Building”) per Resolution <br />No. 4680, on the condition that the Developer enter into this agreement t'* provide for conformance <br />with the City’s Planned Unit Development (PUD) ordinances, and to provide for the installation and <br />maintenance of improvements asociated with the development. <br />NOW, THEREFORE, in consideration of the premises, and of the actual promises and <br />conditions hereinaAer contained, it is hereby agreed as follows: <br />A. General Terms and Conditions <br />Property Description. This Planned Unit Development No. 3 Agreement for Professional <br />Properties of Orono, Inc.
