the following elements: <br />1. Rezoning of the Property and the Adjacent Parcel from RR-IB Single Family Rural <br />Residential District to B-6 Highway Commercial District Planned Unit Development <br />(B-6 PUD); and <br />2. Commercial site plan approval and conditions for proposed office building on the <br />Property and the Adjacent Parcel; and <br />WHEREAS* the Applicants have submitted executed Planned Unit Development No. <br />3 Agreement (City to draft ASAP) providing for the installation of certain improvements as a <br />condition of site plan approval for the construction of a Medical Office Building on the Property and <br />on a portion of the Adjacent Parcel, and which agreement documents the general and detailed <br />conditions for use and development of the Property and the Adjacent Pa4-cel; and <br />WHEREAS, the Applicants have submitted an executed Shared Access and Parking <br />Agreement (Applicants must draft and subntit for City attorney approvalf tve do not have a sample <br />ofsuch an agreement) over the portions of driveways and parking areas within the Adjacent Parcel <br />that will be used to meet the parking requirements for the building to be developed on the Property; <br />and <br />WHEREAS, the Applicants have agreed to grant public casements to the City over <br />existing and proposed trails and sidewalks within the Property and the Adjacent Parcel (presumably <br />as part of the sale transaction between applicants and City\ these easements need to be described <br />legally, and incorporated into a Trait Easement document for which we have standard language); <br />and <br />WHEREAS, the Developer has completed all other requirements of the Zoning Code <br />and related Ordinances of the City including: <br />I.Submittal of Minnehalia Creek Watershed District (MCW'D) permit (No._______) <br />approving the grading and stormwater management facilities plan for the development <br />of the Property and the Adjacent Parcel as proposed per the Grading, Drainage and <br />Erosion Control Plan, Sheet ____dated_______. (Plan sheet must be revised to <br />include connection to the Dahlstromproposedpipe; Council must decide whether <br />an alternative plan is required in the event that Dahlstrom proposed pipe and pond <br />are not constructed) <br />Page 2 of 7
