RESOLUTION APPROVING THE <br />FLEMING TRAIL ADDITION FINAL PLAT AND FINAL DEVELOPMENT PLANS <br />WHEREAS, the City of Long Lake owns certain real property located in the City of Long <br />Lake which includes Lots 1>13, Block 1; Outlets A, B, C, D, and E of the Fleming Trail <br />Addition, Hennepin County, Minnesota (“the Property”); and <br />WHEREAS, the City of Orono recorded a Declaration of Covenants against the property <br />dated May 24,1993, filed August 18, 1993 as Document No. 613S63I; and <br />WHEREAS, the City of Orono recorded an amended Declaration of Covenants dated <br />May__, 200_, filed__________, 2001 as Document No.________; and <br />WHEREAS, the City of Long Lake entered into a Purchase Agreement with Lundgren <br />Bros. Construction, Inc. for the sale and development of 13 single-family homes consistent with <br />the recorded covenants on Lots 1-13, Block 1; Outlets A, B, C, D, and E of the Fleming Trail <br />Addition; and <br />WHEREAS, prior to selling the property to Lundgren Bros. Construction, Inc., the City <br />of Orono needs to approve the final plat and development plans for the Fleming Trail Addition; <br />and <br />WHEREAS, on October 15,2002, the City of Long Lake adopted a resolution approving <br />the final plat and development plans for the Fleming Trail Addition. <br />NOW THEREFORE BE IT RESOLVED, the City Council of the City of Orono that <br />1. The final plat and final development plans are substantially similar to the approved <br />preliminary plat, preliminary development plans, and the existing covenants that run <br />with the land within this subdivision; and <br />2. The final plat and final development plans are consistent with the Declaration of <br />Covenants recorded against the property; and <br />3. The City is not opposed to the concept of modifying the grading plan on and adjacent <br />to Lot 1, Block 1 to pcmiit the inclusion of an earth berm approximately five feet in <br />height to replace the planned retaining wall and to provide for enhanced screening <br />between the Fleming Trail Addition and the residential parcels on Orono Oaks Drive.
