* - ,f <br />\.The layout of the lots meets the Zoning Code requirements for a front/back lot <br />subdivision. <br />2. The proposed use of the land is consistent with the intent of the Comprehensive Plan. <br />3.The variance for the wetland crossing is justified based on the fact the wetland crossing is <br />required for access and the access minimizes impact on the wetland and buffer area. <br />4. Each lot has demonstrated two septic sites for each lot meeting local and state standards. <br />The recommendation included the following conditions: <br />I.All preliminary grading and driveway plans shall be approved by the City Engineer prior <br />to placing this application on the City Council agenda for preliminary plat approval. <br />(Has not been completed). <br />2.The preliminary grading and driveway plans shall also indicate how the grading will <br />impact the existing mature tree growth along Watertown Road. <br />3. <br />4. <br />Standard drainage and utility easements shall be dedicated on the final plat over all <br />wetlands. S’ along all interior property lines and 10’ along all exterior property lines. <br />Required setbacks for Lots I and 2: <br />Lot 2 Front 50’ <br />Side 30’ <br />Rear 50’ <br />Side Adjacent to Outlot A 50’ <br />Loti Front 75 ’ <br />Side 45 ’ <br />Rear 75 ’ <br />5.Final plat shall include recording of a shared driveway maintenance agreement for Lots I <br />and 2. <br />6.Final Plat application shall include all required application fees, including payment of <br />park dedication fees of 8% of the land value prior to subdivision, not to e,xceed $5,550 <br />per lot and stormwater fee of $135,000 based on $2700 per acre. <br />The Stormwater Trunk Fee of $135.000 is a concern to this applicant since the truck fee amounts <br />to $67.500 per lot. The City has recently started a program that generates fees for City <br />stormwater improvements that are specified in the Surface Water Management Plan. <br />COUNCIL ACTION REQUESTED <br />Council shall review the memo, attached as Exhibit B, regarding Staffs position to Mr. Boyer ’s <br />appeal of the Storm Water and Drainage Truck Fee.
