Council Exhibit B <br />REVISED DRAFT (pudpc2.doc) <br />CPUD - COMMERCIAL PLANNED UNIT DEVELOPMENT ORDINANCE <br />Subd. 1. - Purpose. The purpose of the Commercial Planned Unit Development (CPUD) <br />district is to offer an alternative zone to development or redevelopment of properties located in <br />commercial zoning districts in the City of Orono. The CPUD is to allow alternatives to the <br />restrictions made mandatory in the commercial districts in such a manner that more efficient <br />means of providing off-street parking, thoroughfare access, separation of vehicular and <br />pedestrian traffic, stabilization of contiguous property values, buffering of adjacent non ­ <br />commercial areas, and other general and pertinent platming considerations may be developed and <br />utilized. <br />Deviation fix>m the definitive and precise requirements of individual commercial zoning districts <br />within the community can be considered, and conditionally allowed as a CPUD if the Council <br />finds the particular areas to be developed can offer greater value to the community and meet the <br />intent of the Comprehensive Plan. <br />The CPUD district will encourage the following: <br />A. flexibility in land development and redevelopment in order to utilize new techniques of <br />building design, construction and land development; <br />energy conservation through the use of more efficient building designs and sitings and <br />the clustering of buildings; <br />preservation of desirable site characteristics and open space and protection of sensitive <br />environmental features, including steep slopes, poor soils, wetlands and trees; <br />high quality of design and design compatible with surrounding land uses, including both <br />existing and planned; <br />sensitive development in transitional areas located between different land uses and along <br />significant corridors within the city; and <br />development which is consistent with the Comprehensive Plan. <br />B. <br />C. <br />D. <br />E. <br />F. <br />Subd. 2. Flexibility: The uniqueness of each CPUD requires that specifications and <br />standards for streets, utilities, public facilities and subdivisions may be subject to modification <br />from the city ordinances ordinarily governing them. The city council may therefore approve <br />streets, utilities, public facilities and land subdivisions which are not in compliance with usual <br />specifications or ordinance requirements if it finds that strict adherence to such standards or <br />requirements is not required to meet the intent of this section or to protect the health, safety or <br />welfare of the surrounding area or the city as a whole. <br />Subd. 3. Permitted Uses: Any permitted use as regulated in the underlying zoning <br />district and those specific uses approved by the City Council shall be treated as potentially <br />allowable uses within a CPUD district. <br />Subd. 4. Conditional Uses: Any conditional use as regulated in the underlying zoning <br />district shall be treated as potentially allowable uses within a CPUD district. <br />Subd. 5. Accessory Uses: Any accessory use as regulated in the underlying zoning <br />district shall be treated as a potentially allowable accessory use. <br />Page 1 of 9 <br />\
