zoning standards the area is zoned LR-IB (Single Family Lakeshore) -1 acre lots. All of the other <br />lots in this subdivision have remained approximately half acre in size. This lot continues to be in <br />character with the surrounding properties. <br />The city does NOT have an ordinance requiring that 2 lots have to be combined if they are owned by <br />the same person. The ordinances do not prohibit the sale of vacant substandard commonly owned <br />lots except in unsewered areas. However, in order to build on the property it must meet all other <br />zoning standards, (i.e. yard setbacks, hardcover and lot coverage by structures). <br />Note that except for a sliver of existing driveway and a portion of a small shed, the property has not <br />been encroached upon nor used to support development on the adjacent previously commonly-ouued <br />lot. <br />Sewer. The property w*as separately assessed for sewer footage and provided with a sewer stub in <br />1970. Because it was vacant at that time, it was not assessed the sewer unit charge. The unit charge <br />to be collected as a connection charge at the time a building permit is issued is $6,703 for 2002. <br />PLANNING COMMISSION: <br />Planning Commission recommended by a 7 to 0 vote to: <br />To approve application as presented with the following conditions: <br />• Sewer unit charge be paid prior to issuance of building permit. <br />• No other variances be granted to the subject property. <br />• Access location be approved by Hennepin County prior to City Council review. - Dave <br />Zetterstrom from Hennepin County did review the plans, visited the site and has issued a <br />permit approving access location. <br />• Drainage plans be submitted and reviewed by City stafl prior to City Council review. - <br />Drainage plans were submitted and reviewed by Tom Kellogg. His comments are <br />attached as Exhibit A. The comments were forwarded to the applicant and he indicates <br />he will comply with all requirements. <br />• Average Lakeshore Setback - Planning Commission discussed in regards to this <br />application and #02-2827. Both applicants agreed in order to establish average lakeshore <br />setback for these two lots, the existing residence on Lot 8 (Application #02-2827) will be <br />demolished first, then a building permit will be issued for this proposed residence on Lot <br />9 (application #02-2828). <br />STAFF RECOMMENDATION: <br />To approve the enclosed resolution. <br />(Staff has assigned an address to the subject property - 4525 North Shore Drive.) <br />COUNCIL ACTION REQUESTED: <br />To adopt or amend the enclosed resolution.
