MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, July 22,2002 <br />6:30 o*clock p.m. <br />(UlO) §02-2797JAMES MURPHY AND SANDRA SMITH, 30 ORONO ORCHARD ROAD <br />NORTH, CONDITIONAL USE PERMIT- Continued <br />Attorney Barrett indicated that the permit needs to run with the property and not with the <br />property owners and suggested making the CUP a renewable thing allowing three horses without <br />a time limit. <br />Sansevere moved, Mayor Peterson seconded, to adopt RESOLUTION NO. 4836, a <br />conditional use permit allowing three horses to be permitted on the property located at 30 <br />Orono Orchard Road North and approving the Planning Commbsion recommendation <br />with the exclusion of the 10 year time limit, leaving the CUP open ended. VOTE: Ayes 2, <br />Nays 0, and Murphy abstaining. <br />*(#11) #02-2798 FRED SHEARER, 1405 PARK DRIVE - VARIANCES - RESOLUTION <br />NO. 4837 <br />Sansevere moved, Murphy seconded, to adopt RESOLUTION NO. 4837, granting <br />variances for side yard and front yard setbacks, and hardcover variance in the 75-250 ’ <br />tone to permit construction of an attached garage to the existing residence located at 1405 <br />Park Drive. VOTE: Ayes 3, Nays 0. <br />*(#12) #02-2799 TERESA KOCH, 2225 BAYVIEW PLACE - VARIANCES - <br />RESOLUTION NO. 4838 <br />Sansevere moved, Murphy seconded, to adopt RESOLUTION NO. 4838, granting <br />variances for lot area, lot width, and hardcover in the 250-500 ’ setback to permit <br />construction of a new residence and additional driveway for the property located at 2225 <br />Bayview Place. VOTE: Ayes 3, Nays 0. <br />*(#13) #02-2800 MARLYS MCCARTY, 225 TONKA AVTNUE - VARIANCES - <br />RESOLUTION NO. 4839 <br />Sansevere moved, Murphy seconded, to adopt RESOLUTION NO. 4839 granting variances <br />for front yard, rear yard, lot area, and lot width for the construction of a new residence to <br />replace the existing residence on the property located at 225 Tonka Avenue.
