GafTron <br />Title: Planning Director ^ <br />Agenda Section: <br />City Administrator's Report <br />Item Description: Revise Transient Merchants License <br />• Approve Ordinance Amendment Language <br />Attachments: . <br />A - Ordinance Language <br />B > Existing Transient Merchant License provisions (Section 5.30) <br />Under Section 5.30, Subdivision 3(H), transient merchants can only be licensed for 10 days per year. <br />On May 13 Council voted 4-0 to revise the transient merchant ordinance provisions to allow for the <br />extension of transient merchant licenses for an additional 50 days per year. Council then granted <br />such an extension to Cliff Otten for the concession stand for which he is applying via a PUD <br />Agreement amendment. <br />The attached ordinance in adoption format provides for a 50 day extension subject to application and <br />at the sole discretion of the City Council. Applying for the extension separately from the initial <br />license will protect the City in that during the initial 10-day licensure the City will gain some insight <br />into whether an extension is appropriate. <br />The ordinance also clarifies that the effective dates for a transient merchants license (i.e. all licensed <br />days) must be in a single calendar year. <br />COUNCIL ACTION REQUESTED <br />Motion to approve the language of the attached ordinance and authorize its publication.
