r <br />A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 2 AND <br />SECTION 10.56, SUBDIVISION 16 (L) (2) <br />FILE NO. #02-2778 <br />•WHEREAS, Kevin Manley, of Manley Brothers Construction, (hereinafter "the <br />applicant") is owner of the property located at 1973 Fagemess Point Road within the City of <br />Orono (hereinafter "the City") and is legally described as follows; <br />Lot 7, Fagemess, Hennepin County, Minnesota <br />(hereinafler "the property"); and <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on April IS, 2002, at which times all persons desiring to <br />be heard concerning this application were given the onportunity to speak thereon; and <br />WHEREAS, the applicant applied to the City of Orono for variances to <br />Municipal Zoning Code Section 10.22, Subdivision 1 and Section 10.56, Subdivision 16 (C) <br />(6) to permit an expansion of the roof line and raising the roof within 75' of the lakeshore; and <br />for variances to Section 10.22, Subdivision 2 and Section 10.56, Subdivision 16 (L) (2) to <br />permit additional hardcover within the 75-250' lakeshore setback over 25% and to Section <br />10.03, Subdivision 14 (C) to permit additional structure over 15% on the property; and <br />WHEREAS, the Council approved variances to permit the expansion of the roof <br />line and raising the roof of the house on April 22, 2002; and <br />WHEREAS, the Council tabled the variance request for the deck addition on <br />April 22, 2002 to allow the propeny owner to revise the plan to lower the deck below 6' to <br />eliminate the variance request that increases the lot coverage by structure; and <br />Minnesota; <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />I.The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variances would not adversely affect traffic conditions, light, air nor <br />Page 1 of 4 <br />lUBti
