, if i‘. <br />GlTYof ORONO <br />4*RESOLUTION OF THE CITY COUNCIL <br />NO. _ <br />A RESOLUTION APPROVING <br />THE RELEASE OF CONSERVATION AND FLOWAGE EASEMENTS <br />ON THE PROPERTIES AT <br />1230,1260 AND 1290 ORONO OAKS DRIVE <br />THROUGH QUIT CLAIM DEEDS <br />'WHEREAS, the Orono Oaks Drive subdivision approval included the granting to <br />the City of Conservation and Flowage Easements to protect existing wetlands on the property, <br />including the properties at 1230,1260 and 1290 Orono Oaks Drive; and . ’ <br />WHEREAS, the legal descriptions of these three properties are: <br />Lot 3, Block 1, Lot 4, Block 1, and Lot 5, Block 1, Orono Oaks; and <br />WHEREAS, the plan for the Highway 12 upgrade project includes the acquisition <br />and filHr.g of portions of these wetlands to provide right-of-way for the Highway 12 project; and <br />WHEREAS, the Minnehaha Creek Watershed District is the local government unit <br />responsible for wetland protection under the Wetland Conservation Act; and <br />WHEREAS, Minnehaha Creek Watershed District staffhas assured the City that they <br />will require proper mitigation of all wetland filling for the Highway 12 project. <br />NOW, THEREFORE, BE IT RESOLVED that the Orono City Council does <br />hereby approve the release of Conservation and Flowage Easements on the properties at 1230,1260 <br />and 1290 Orono Oaks Drive through Quit Claim Deeds. <br />Adopted by the City Council of the City of Orono, Minnesota at a regular meeting <br />held this 13th day of May, 2002. <br />ATTEST: <br />Linda S.
