■'l <br />The topography of the property is fairly flat except approximately 45' from the lakeshore. At that <br />point it drops significantly to the lake. (See Exhibit C). <br />There is not a permit on file for the deck or shed, however it appears it has been there for many <br />years. Researching city files, a boat house was located there at least until 1986. <br />The zoning code allows stairways up to 4' wide, but landings no more than 32 s.f in area. Decks and <br />roofed shelters are not allowed. The shelter is painted white and is quKe conspicuous against the <br />brown retaining wall as viewed from the lake. <br />Statement of Hardship <br />Tlie applicai'.ts have included their statement of hardship in Exhibit B. The applicants should also <br />be asked for their testimony regarding this issue. <br />Issues for Consideration <br />1.The steep topography to the lake requires some form of landing to iriu'.sition from the steps <br />to a dock. <br />There is not a permit on file for the deck or shed by the lake, however it appears it has been <br />there for many years. <br />3. <br />4. <br />The deck and shed are in good condition and structurally sound. <br />The deck and shed do not obscure adjacent neighbors views of the lake. <br />5. <br />6. <br />The new residence conforms to all zoning standards. <br />Is there a legitimate hardship that supports approval for keeping the roofed structure and the <br />deck? <br />7.
