They are requesting a hardcover variance (0-75') to allow a 216 s.f. deck and 20 s.f. shed <br />located by the lakeshore to remain on the property. A portion of the deck has a roof, but is not <br />enclosed. <br />Discussion: January. 2002 the applicants received a permit to build a new residence on the property. <br />Ihe new residence meets all standards for the LR-IB zoning district All that remains in the 0-75' <br />setback zone are steps leading to the lake. deck. shed, and two retaining walls. <br />'1 he topography of the property is fairly flat except approximately 45 ’ from the lakeshore. At that <br />point it drops significantly to the lake. <br />There is not a permit on file for the deck or shed, however it appears it has been there for many <br />vears. Researching citv files, a boat house was located there at least until 1986. <br />The zoning code allows stairways up to 4' wide, but landings no more than 32 s.f. in area. Decks and <br />roofed shelters are not allowed. The shelter is painted white and is quite conspicuous against the <br />brown retaining wall as viewed from the lake. <br />Pertinent Code Section: <br />1. Section 10.22. Subd. 1 (B): Lakeshore Setback: No principal or accessory structure shall be <br />located within 75 feet of the lakeshore. Variance Request: 1 o permit a variance to allow a deck to <br />be within 75’ of the lakeshore. <br />2. Section 10.56, Subd. 16 (E,F): Water Oriented Accessory Structures/Stainvays Lifts and <br />Landings: The only water oriented accessory structures that are allowed in the 0-75' setback zone <br />are lock boxes up to 20 s.f area and no more than 4' high. Stairways up to 4' wide are allowed in <br />the 0-75' zone with landings (i.e. decks) no more than 32 s.f in area.
