Pertinent Ordinances <br />Section 10.25. Subdivision 6 (B): Variances requested to lot area and lot width to permit <br />construction of a new residence on the property in the LR-IC district less than '/i acre and <br />100' width. The defined lot area, absent the private driveway area, is 5.462 s.f The defined <br />lot width is ^ at the lakeshore and defined structure setback. <br />The City of Orono has routinely granted variances to lot area and lot width for <br />redevelopment on non-conforming lots in the City. The property does meet the criteria that <br />is normally considered when reviewing such proposals. The property is connected to <br />sanitary sewer and the house would be located in an area above the regulatory flood plain. <br />Section 10.55. Subdivision 8. Section 10.22. Subdivisions 1 and 2. and Subdivision 10.56. <br />Subdivision 16 (U1 and 2: Variances requested for hardcover and structure within 75* of the <br />lakeshore, where no hardcover or structure is allowed, and a variance to permit greater than <br />25% hardcover in the 75-250' of the lakeshore. <br />Total Area 0-75' = 3,750 s.f. <br />Allowed 0-75' = 0 s.f. <br />Proposed 0-75' = 615 s.f. (16.4%) <br />Existing 0-75' = 660 (17.6%) <br />Total Area 75-250' - 1,712 s.f. * Does not include 1,153 s.f. of shared driveway <br />Allowed 75-250' = 428 s.f. <br />Proposed 75-250' = 884 s.f. (51.6%) <br />Existing 75-250' = 932 (54.4%) <br />Overall hardcover on the property would decrease, however a greater percentage of the <br />hardcover would be for the house. The size of the existing house is 599 s.f the proposed <br />house would be 1,176 s.f. <br />The land elevation is about -4' higher than the ordinary high water level of Lake Minnetonka. <br />The lot cannot accommodate a basement. <br />The new house is proposed to be located 53'from the lakeshore where a 75' setback is <br />required. Both adjacent houses are within 50' of the lakeshore. The new house is located <br />to meet the minimum 50'lakeshore setback as required by the DNR.
