1^02-2747 Eagle Crest North West Townhomes/Tonka Ventures <br />3749 Livingston Avenue <br />Pace 2 of 2 ---------------------------------------------------------- <br />Planning Commission Recommendation <br />Planning Commission voted 6 to 0 to recommend approval of the easement vacation. <br />Planning Commission also heard from several adjacent property owners regarding the condition of the <br />property. The final approved landscape plans included trees to replace some that were cleared to allow <br />installation of sewer and water lines. The neighboring property owners stated there are additional trees that <br />were to have been planted. Additionally, there is some erosion on the site that is depositing material on <br />adjacent lots. The Planning Commission requested Staff forward the comments of the neighboring residents <br />to the Council. <br />The City of Orono holds a Letter of Credit for the improvements. The Letter of Credit is open to September <br />1,2002. <br />COUNCIL ACTION REQUESTED <br />1 : <br />• j <br />Motion to adopt the attached resolution approving the vacation of the drainage and utility easement. <br />t
