The drainage <br />and utility easement was dedicated on the plat of Lake Minnetonka Woods in 1999. Lake Minnetonka <br />Woods is the 29-unit town house development on Livingston Avenue. <br />The purpose of the vacation request is to construct an end town house unit 1.5' into the easement area. <br />Copies of the plat show ing the easement area and propos"'! vacation are attached. The total request w ould <br />vacate an area of less than 10 s.f. The easement area c itains both a sewer line and watermain. The closest <br />service is the sewer line which would be located 7.8' when the building is constructed. <br />1, it) has notified utility companies of the request to vacate a portion of the easement. No concerns from <br />those utilities notified have been received as of the date of this memo. Qwest and Reliant <br />Energy/Minnegasco have both responded and stated they have no facilities w ithin the easement area. <br />The City of Orono has determined there are methods available to provide maintenance to the serv ice lines <br />without impacting the building based on 7.8' to the comer of the building. <br />Staff Recommendation <br />Staff recommends approval of the request to vacate a portion of drainage and utility easement. The <br />recommendation is based on the fact that the public use of the easement for sewer and water purposes are <br />not negatively impacted by the vacation, and no negative comments have been received from public utilities. <br />J
