#01-2742 Douglas and Roban Smith <br />4195 Highwood Road <br />Page 2 of 2 _____________ <br />By a vote of 6 to 0 the Planning Commission recommended approval to an expansion of the detached garage. <br />The recommendation differs from the applicant's request because the Planning Commission stated the size <br />of the detached garage should not be greater than 1,000 s.f. <br />I.The applicant’s request to extend the existing building by 12 ft. would result in a building <br />size of 1,056 s.f. The rational behind the recommendation to allow a building with a <br />maximum size of 1,000 s.f. is based on the code classification of accessory buildings over <br />1,000 s.f. in size. Any building in that category is defined as an oversized accessory <br />building. Oversized accessory buildings are required to meet principal building setbacks. <br />In this case the building would be required to meet a 30' setback rather than 1 5 ’. <br />The garage was approved with a previous variance to be located only 9' from the property <br />line. <br />3.Property owners could construct additional accessory buildings on the property without <br />requiring variances. An addition to the existing garage would not require additional <br />buildings on the property. <br />4.The building addition is not within a required yard setback. There is no change proposed <br />for the portion of the building located 9’ from the property line. <br />Staff Recommendation: <br />To adopt attached resolution. The resolution approves variances for a 10' residential addition within the <br />average lakeshore setback and to permit an addition to the detached garage. The resolution limits the garage <br />addition to extend from the south side of the building, and to not e.xceed a total building size of 1,000 s.f, <br />as recommended by the Planning Commission. <br />COUNCIL ACTION REQUESTED <br />Motion to adopt the attached resolution approving variances. <br />J
