mcctINQ
Application Date:
60 Day Deadline:
12/19/01
2/17/02 2 8 2002
REQUEST FOR COUNCIL ACTION I v>r '-'HO/VO
DATE: January 24,2002
ITEM NO.
Department Approval:
Name Paul Weinberger
Title Zoning Administrator
Administrator Reviewed:Agenda Section:
Zoning
Item Description:#01-2742 Douglas and Roban Smith
4195 Highwood Road
Variances
Zoning District:LR-IB One Family Lakeshore Residential District (I acre)
Lbt of Exhibits
A Resolution
B Site Plan
C Planning Report (January 4,2002)
Application: Application is two fold. First the applicants have applied for variances to permit a 10'
addition to the east side of the existing residence to enlarge the kitchen and mud room. The bedrooms below
the kitchen would also be increased by 10' and a dormer would be added to the second floor bedroom. The
addition would encroach into the average lakeshore setback.
Secondly, a variance was requested to permit a 12' wide storage addition to the detached garage. The
existing garage has previously had a variance to permit a 9' street setback, where IS' is normally required.
The proposed addition would be to the opposite side of the garage to not decrease the 9' street setback.
Planning Commission Recommendation: Planning Commission recommended approval of the variance
to permit the 10' residential addition into the average lakeshore setback based on the following findings of
fact:
1.The intent of the average lakeshore setback ordinance is to protect lake views to adjacent
residential buildings.
Views from the house, located east of the applicant’s property, would be minimally
impacted to the lake based on the side by side location of the houses.
3.
4.
The house to the west is located approximately 120' from the applicant’s house.
The applicant’s house is located at a much higher elevation than the house located to the
west.
5.The addition is to east side of the house. There is no increase to the visual mass of the
neighbor’s house on the lakeside that is visible to the property to the west
V"
'■ «'■
I-.- ■ “Tt
