The requested hardcover is for a 7’ e.xtension to the e.xisting lakeside deck at the <br />northwest comer of the residence. Secondly, property owners have proposed to construct a 3 '/s’ x 25 ’ <br />walkway that would connect the lakeside deck to a small deck (existing doorway from residence) on the west <br />side. 1 he total hardcover would increase from 27.1% to 27.9?o where 25% is allowed. <br />This e.xtension would provide wheelchair accessability to the lakeside deck from inside the residence. <br />Currently, the interior of the residence has a step that one must go dow n in order to access the lakeside deck. <br />The applicants mother-in-law lives with them and is in a wheel chair. Also there is no exterior stairway <br />access to the deck. <br />In June 2001 the applicants applied for and received a permit to repair the deck discussed above and to <br />construct a shed on the rear of the property. When the shed was built it was believed to be 10 ’ off the <br />property line. When the survey was completed for the deck addition, it was found to be 7’ and 8.9’ from the <br />property line. A 1 20 s.f. shed needs to be setback 1 0’ from the property line. No surv ey was required to build <br />the shed because the City does consider accessory buildings 1 20 s.f. or less e.xempt from the requirement to <br />complete a survey. However, buildings are required to meet all zoning standards. The property owners did <br />have a permit for the shed and it was believed to have been constructed in a location meeting all zoning <br />standards. It was not until a survey was completed for the deck variance that the setback encroachment was <br />discovered. <br />Planning Commission Recommendation: Planning Commission recommended approval by a vote of 5 <br />to 1 to approve the variance to permit additional hardcover in the 75-250 ’ lakeshore setback for a 7’ deck <br />extension and addition of the walkw ay to connect the lakeside deck to a small deck. Planning Commission <br />made the following findings:
