CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 3 3 g r <br />3. The Orono Planning Commission reviewed this application on October 18, 1993, <br />and recommended approval of the proposed variance application as amended <br />based upon the following fmdings: <br />A. The proposed improvements to the property result in a reduction of <br />hardcover in the 0-75 ’ zone from 23.3% to 19.7%. although no <br />improvements are proposed in that zone. Further hardcover in the 75- <br />250 ’ zone will be reduced from the current level of 72% down to 58.2%, <br />a reduction of approximately 1,128 s.f. hardcover. <br />B. Based on the existing drainage patterns of the property, runoff produced <br />from the structures placed within the 75-250 ’ setback area will not drain <br />directly to the lake but will drain to the street which drains directly to the <br />lake, hence the proposed hardcover reductions in the 75-250' zone are <br />desirable. <br />C. No major land alterations are proposed as a result of the structural <br />improvements. <br />D. The increase in lot coverage by structures is not incongruous with the <br />basic development pattern of the immediate neighborhood. <br />4. The current variance request is a revision of Application #1750/Resolution #3183 <br />which included the family room addition and relocation/construction of a new <br />detached garage. The garage is no longer a part of the proposal. <br />5. The City Council fmds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variance would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicants, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial property <br />right of the applicants; and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the City. <br />Page 2 of 6
