3
4.
The property is located in the LR-IC Zoning District, where 21.780 s.f. or .5 acre is
the minimum required lot area. The property consists of approximately 12.225 s.f.
or .28 acres.
The Orono Planning Commission reviewed this application on Januarv’ 22.2021 and
recommended approval of the proposed variances based upon the following findings;
A. Resolution 183 approved 2.533 s.f. (20%) lot coverage by structures on the
property.
B. The deck is an equal replacement to what existed. The 'valkway is being
repaired.
C. The deck and walkway provide access from the second stor>‘ of the residence
to the lakeside of the property.
D. The hardcover in the 0-75' setback area is increasing minimally (30 s.t.) to
meet code standards. The removal of 177 s.f. of non-conforming landscape
plastic in th eO-75’ setback area is required in order for the site to meet city
requirements.
n. The deck and walk' .ay have existed since at least 1992.
The City Council finds that the conditions existing on this property are peculiar to
it and do not apply generally to other property in this zoning district; that granting
the variances will not adversely affect traffic conditions, light, air. nor pose a fire
hazard or other danger to neighboring property; would not merely sene as a
convenience to the applicants, but is necessarv' to alleviate a demonstrable hardship
or dilTiculty; is necessary to preserve a substantial property right of the applicants;
and would be in keeping with the spirit and intent of the Zoning Code and
Comprehensive Plan of the City.
The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City' Staff, comments by
the applicants and the effect of the proposed variances on the health, safety and
welfare of the community.
Page 2 of 6
