A RESOLUTION GRANTING AFTER THE FACT VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 14(C), <br />SECTION 10.22, SUBDIVISION 2 AND <br />SECTION 10.56, SUBDIVISION 16(L)(2) <br />SECTION 10.22, SUBDIVISION 1 (B) AND <br />FILE NO. 02-2737 <br />WHEREAS. Charles D. Pyle and Shirley Pyle, (hereinafter "the applicants") arc the <br />owners of the property located at 3548 Ivy Place within the City ofOrono (hereinafter "the City") <br />and legally deseribed as follows: <br />Lot 174, Taylor’s Subdivision of Spring Park Lots. Hennepin County, Minnesota <br />(hereinafter “the property”); and <br />WHEREAS, the applicants have applied to the City for after the fact variance:- to <br />Municipal Zoning Code Section 10.03, Subdivision 14 (C) to pemit replacement of an existing <br />lakeside deck and walkway repair permitting 2,440 s. f. (20%) lot coverage b> structures w here 2.440 <br />s.L (20%) exists and 1,833.75 s.f. (1 5%) is allowed. Section 10.22. Subdivision 2 and Section 1 0.56, <br />Subdivision 16 (L)(2) to permit 761.5 s.f. (18.67%) of hardcover in the 0-75 ’ setback area where <br />761.5 s.f. (1 8.67%) exists and 0 s.f. (0%) is allowed, and Section 1 0.22. Subdivision I (B) to permit <br />243 s.f of structure w ithin 75’ of the lakcshore; and <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on January' 22. 2002, at which time all persons desiring to be <br />heard concerning this application were given the opportunity to speak thereon. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono. <br />NMnnesota: <br />FINDINGS <br />1 .
