• • <br />GITYofORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. _ 4 9 8 9 <br />CONCLUSIONS, ORDER, AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby grants variances to <br />Municipal Zoning Code Section 10.03, Subdivision 14(C); Section 10.22, Subdivision 1 (B); Section <br />10.22, Subdivision 2; and Section 10.56, Subdivision 16 (C)(6) and Section 10.56, SubdMsion 16 <br />(L)(2) to replace an e.xisting 507.6 s.f. lakeside deck, enclosing 151 s.f as patio area, \%itb 2,848 s.f. <br />(16.3%) of structure where 2,620 s.f. (15%) is pendned; 6,442 s.f. (57.08%) of hardcover where <br />2,821.5 s.f. (25%) is permitted in the 75’-250 ’ hardcover zone; and a 21* encroachment into the <br />average lakeshore setback. Approval is subject to the following conditions: <br />1.Council approval is based on the site plan submitted by the applicant attached to this <br />resolution as Exhibit A. Any further amendments to the site plan may require further <br />Planning Commission and City Council review*. <br />Approval is subject to the following: <br />a) 1 ,506 s.f. of existing landscape plastic hardcover must be removed on the <br />property; and <br />b) in the 0-75’ hardcover zone, the 681 s.f. concrete patio must be removed to <br />reduce the hardcover from 1,341 s.f. (24.86%) to 660 s.f. (12.23%). <br />3.Authorities granted by this variance ren with the property not with the applicants, but <br />are permissive only and must be exercised by application for a building permit within <br />one year of the date of Council appro\'a!, or these variances will expire on that date <br />(February 24,2004). <br />4.Violation of or non-compliance with a.ny of the terms and conditions of this variance <br />shall constitute a violation of the zoning code, shall automatically terminate any <br />authority granted herein, arid shall be punishable as a misdemeanor. <br />5.The undersigned applicants have read, understood and hereby agree to the terms of <br />this resolution and on behalf of the.*r.selves, their heirs, successors and assigns, <br />hereby agree to the recording of this resolution in the Chain of Title of the property. <br />Page 3 of 6
