The property consio of approximately 0.4 acres. <br />The Orono Planning Commission reviewed this applicaUon on February-19,2003 <br />and recommended approval by a vote of 6 to 0. ' * <br />4. The Planning Commission made the following Crdings of fact: <br />A. The deck has existed for many years in the Iccatioa of the proposed deck; <br />B. Replacement of the deck as it currently exists and enclosing a small area will not <br />increase the lot coverage by stmcture, hardco-. er in the 75 ’-250 ’ hardcover zone <br />or change the average lakeshore setback; <br />C. The deck will continue to provide a landing fc-r two sliding glass doors located on <br />the lakeside of the house; <br />D. The neighbors ’ views of the lake are not grea-Jy affected by the locadon of the <br />deck or the proposed patio enclosure; <br />E* There exists 1,506 s.f. of non*confomung plsisric hardcover on the property that <br />must be removed; and <br />F. Excessive existing hardcover in the 0.75 ’ zone can be substantially reduced by <br />removirg a portion of the concrete patio near the lake. <br />The City Council finds that the conditions existing on t}*;$ property are peculiar to it <br />and do not apply generally to other property in this zoning district; that craating the <br />variances will not adversely affect traffic conditicis, light, air, nor pose a fire hazard <br />or other danger to neighboring property, would nc: merely serv e as a convenience to <br />the applicants, but is necessary to alleviate a demonstrable hardship or diSculty, is <br />necessary to preserve a substantial property right of the applicants; a.nd would be* in <br />keeping with the spirit and intent of the Zoning Cede and Comprehensive Plan of the <br />City. <br />The City Council has considered this application, including the findings and <br />recommendations of the Planning Commission, reports by City Staff, comments by <br />the applicants and the effect of the proposed variances on the health, safely and <br />welfare of the community. <br />Page 2 of 6 <br />M
