< <br />A RESOLUTION GRANTING <br />A CONDITIONAL USE PERMIT <br />FOR PLUMBING IN AN ACCESSORY STRUCTURE <br />PER MUNICIRAL ZONING CODE <br />SECTION 78-303. SUBDIVISION (17) <br />HLE #03-2929 <br />WHEREAS* JcfTrey L. Martineau and Melissa L. Ottinger, husband and wife, <br />(hereinafter "the applicants") are owners of the property located at 256S North Shore Drive within <br />the City of Orono (hereinafter "City") and legally described as: <br />Attached “Exhibit A” (hereinafter "the property"); and <br />WHEREAS, the applicants have applied to the City for a conditional use permit per <br />Municipal Zoning Code Section 78-303, Subdivision (17) to allow plumbing including a toilet, sink <br />and shower to be installed in a proposed accessory structure; and <br />WHEREAS* after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on September IS, 2003, at which times all persons desiring to be <br />heard concerning this application were given the opportunity to speak thereon. <br />Minnesota; <br />NOW* THEREFORE* BE IT RESOLVED by the City Council of Orono, <br />nXDINGS <br />1. <br />2. <br />This application was reviewed as Zoning File #03-2929. <br />The property is located in the LR-1A Zoning District, where 2 acres is the minimum <br />lot area. The property is approximately 1.47 acres in gross area including wetlands. <br />3.The Planning Commission reviewed this application on September 15,2003 and on <br />a vote of 7-0 recommended approval of a CUP for plumbing in the accessory <br />structure, based on the following findings: <br />Page 1 of 6
