A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTIONS 78-281 (B) AND 78-1279.6 <br />- FILE NO. 03-2905 <br />WHEREAS, Scott J. Nagel and Heidi B. Nagel, husband and wife, (hereinafter "the <br />applicants") are the owners of the property located at 995 Wildhurst Trail within the City of Orono <br />(hereinafter the "City") and legally described as follows: <br />The East 111.00 feet of the Southeast Quarter of the Northeast Quarter of the Northwest <br />Quarter of Section 7, Township 117, Range 23; Hennepin County, Minnesota: subject to a <br />permanent easement for street, utility and drainage purposes over and across the south 8.00 <br />feet of the above described property; <br />(hereinafter the "property"); and <br />WHEREAS, the applicants have made application to the City of Orono for a variance <br />to Orono Municipal Zoning Code Sections 78-281(b) and 78-1279.6 to allow construction of a <br />residence addition encroaching 6* into the average lakeshore setback where no encroachment is <br />normally allowed. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of Orono. <br />Minnesota: <br />FINDINGS <br />1. <br />2. <br />This application was reviewed as Zoning File #03-2905. <br />The property is located in the LR-IB Lakeshore Residential Zoning District, which <br />requires minimum lot area of 1.0 acres and minimum lot width of 140*. <br />3.The Planning Commission initially reviewed this application at a public hearing held <br />on June 16,2003 and tabled the application for revisions, specifically to eliminate the <br />then proposed garage addition which would have resulted in structural lot coverage <br />exceeding 15% and to show how hardcover could be reduced to the levels approved <br />via Resolution No. 3578 in 1995. <br />4.The Planning Commission reviewed applicants ’ revised plan at a public hearing held <br />on August 18,2003 at which time the applicant requested tabling for further minor <br />plan revisions. <br />Page 1 of 5 ' i <br />U
