The purpose of this <br />Icilvi is to esiabllai. ,!.v* tonus undci >wilv;ii Kennedy &. Graven would represent the City of Orono <br />in connection with those matters. Please provide copies of this letter agreement to the City <br />Council for its consideration and approval. <br />As I indicated during our discussion, condemnuiion proceedings involve many deadlines, and it is <br />important that the City respond promptly in order to protect its rights. Because of a new statutory <br />deadline for recovering appraisal fees, 1 recommend that the City proceed immediately with <br />retaining a qualified real estate appraiser to provide an estimate of damages from the taking. In <br />addition to approving the retainer agreement as set forth below, please ask the City Council to <br />authorize staff and our fimi to retain an appraiser on behr if of the City. <br />It is important that we have a clear understanding as to the scope of our representation and as to <br />the matter of payment of fees, disbursements and other expenses. The scope and terms of our <br />representation are as follows: <br />1. City of Orono (“Client”) hereby retains and employs the law finn of Kennedy & Graven, <br />Chartered (“Finn”) to provide legal services in connection with the above-referenced <br />condemnation proceedings commenced by the State of Minnesota and affecting Client’s <br />properties. <br />CAHOJTOSlvl <br />KG400-I1
