Although the City was in the process of negotiations with Mn/DOT regarding the value <br />of the properties, Mn/DOT has initiated a condemnation action to acquire the properties. It is <br />important the City be represented in this process by an expert in the area of condemnation law. Both <br />Council member White and Desyl Peterson, Minnetonka City Attorney, recommended attorneys <br />from tlic firm of Keimedy & Graven. <br />Gabriel Jabbour and I met wth Corinne Thomson, of Kennedy & Graven, who has been representing <br />the City of Minnetonka in condemnation actions. We provided her with the background on the two <br />parcels and the condemnation action, and were impressed with her knowledge arid approach. <br />Attached is a letter/retainer agreement from Corinne Thomson/Kennedy & Graven, setting out the <br />scope and terms of their representation. <br />COUNCIL ACTION REQUESTED: <br />Motion to approve the Retainer Agreement for Legal Services with the firm of Kennedy & Graven, <br />with Corinne Thomson being the principal attorney, and to authorize the City Administrator to sign <br />the agreement. <br />■■ F.:. » ■■
