The apartment is for the sole use of the occupants of the principal residence, <br />including their domestic employees or non-paying guests. <br />The applicant has indicated that only family and non-paying guests Mill ttse the <br />apartment during overnight or extended stays. <br />2. There is one access door to the apartment from within the principal structure and <br />such door shall be the primary access to the apartment. <br />The primary and only access door to the apartment is through the mudroom of the <br />primary residence. Direct access cannot be gained through the outside of the <br />home. <br />3. Concerns of parking, sewage treatment, entry"way, and interior access methods <br />shall rll be disclosed. <br />As shown on the survey. 5,250 s.f of driveway exists in the 75-250' zone and <br />5,477 s.f. of driveway exists in the 250-500' zone, therefore providing adequate <br />par king for the non-rental apartment. The applicants have spoken to City staff <br />and have addressed sewage treatment for the non-rental apartment. However, <br />city staff directed the applicants to provide the utilities for the apartment without <br />going outside the boundaries of the property lin's The only feasible uo>’ to do <br />this is by having separate meters, contrary to what the Ordinance normally <br />requires. This issue will be discussed in the Variance section of the report. The <br />entryyvay has been disclosed and discussed above and meets the CUP <br />requirements. <br />4. Such apartment shall not have utilities metered separately from the principal <br />residence utilities and shall not have a separate street address. <br />The applicants are requesting a variance to this condition per City staff direction. <br />This will be discussed in O' Variance section of this report. <br />The applicants meet all conditions set forth by the Ordinance for non-rental apartments, <br />with the exception of the variance needed for #4 which staff will recommend approval <br />for. Therefore, staff is recommending approval of this conditional use permit to allow a <br />non-rental guest apartmi n to be constructed above the e.xisting attached garage. <br />Water Meter Variance <br />In conjunction with ti e above mentioned conditional use permits, a variance is required <br />because one of the conditions listed under the CUP in the Zoning Ordinance cannot be <br />met. The Ordinance requires that utilities for non-rental guest apartments not be metered <br />separately which is what the applicant is proposing.
