M3-2933 <br />Augatt 11,2003 <br />Page 4 of9 <br />The primary use of the plumbing and entertainment facility will be in conjunction <br />with t/sp of the pool. The characteristics of the neighborhood will not change by <br />albwir-^ pWmbing in the applicant ‘s proposed garage/entertainment room <br />because many of the homes on Old Beach Road currently have pools. <br />2. The Council finds that the plumbing flxtures proposed are in keeping with the <br />intended use of the accessory building. <br />The only fixtures proposed are toilet rooms to be used in conjunction with the <br />pool. One of the intended uses of plumbing in an accessory building is for pool <br />houses which is what the applicant's are essentially proposing. <br />3. The property is 2.0 acres in area or larger. <br />The applicant's property is 2.356 acres, in e.xcess of Zoning Ordinance <br />requirements. <br />4. The accessory building is conforming in location, size and height. <br />The accessory building will conform to all location, size and height requirements. <br />The accessory building will be setback 15 'from the side property line and 107 ’ <br />frwn the roar/street side when 10 'feet is required. The building will be <br />approximately 990 s.f in size, wed within the 1,200 s.f maximum, and the <br />building will be approximately 17' in height. <br />5.The property owner agrees to the filing of a covenant in the title of the property <br />providing that: <br />a. The accessory building will not be used for a home occupation unless <br />specifically approved by the City or if allowed by City Code. <br />b. The accessory building will not be used as a dwelling unless a guest house <br />CUP is obtained. <br />c. The accessory building will not be rented. leased or otherwise provided for <br />use as a duelling under any circumstances. <br />The applicant has indicated that they will not use the building for a home <br />occupation or guest house and that it will not be rented, leased or otherw ise used <br />as a dwelling but merely for use in conjunction with the pool <br />The proposal meets all of the above requirements; therefore staff is recommending <br />approval of a conditional use permit to allow plumbing in the proposed detached <br />garage/entertainment room. <br />The applicant is also proposing to remodel the existing guest suite above the existing: <br />attached garage. This includes adding a toilet room, closets, and kitchen facilities. This <br />also requires a conditional use permit for a non-rental guest apartment due to its ability to <br />be used as a full time apartment.
