ad%ersely affect traffic conditions, light, air nor pose a fire hazard or other <br />danger to neighboring property; would not merely serve as a convenience <br />to the applicants, but is necessary to alleviate a demonstrable hardship or <br />difficulty; is necessary to preser\e a substantial property right of the <br />applicants; and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants conditional use permits and variances to Orono Municipal Zoning Code Section <br />10.20, Subdivision 3 (g & q) to allow a non-rental guest apartment and plumbing in an <br />accessory building and variances to Orono Municipal Zoning Code Section 10.20 <br />Subdivision 3 (g). Section 10.22, Subdivision 2, and Section 10.56 Subdivision 16 (1) to <br />allow the new plumbing for the non-rental guest apartment to be run off a separate meter <br />and hardcover to remain exceeding the minimum amounts allowed by Ordinance in the <br />75-250* 7onc for the construction of a 3-car Hf*tachcd garage/entertninment room and <br />associated patio in the 250-500 ’ zone subject to the following conditions: <br />1.Council approval is based on the site plan submitted by the applicants and <br />annotated by City staff, attached to this Resolution as Hxhibit A. Any <br />amendments to the site plan which are not in conformity with City codes will <br />require furtlter Planning Commission and City Council review. <br />Approval is based on the hardcover amounts listed in the planning report. This <br />consists of 0% hardcover in the 0-75 ’ zone, 34% hardcover in the 75-250 ’ zone <br />and 27.4% hardcover in the 250-500 ’ zone. <br />3.Hardcover in the 0-75 ’ zone sliall not increase above the 0%. Hardcover in the <br />75-250* zone shall be limited to 13.255 s.f or 34% per the prop.)sed plan and <br />hardcover allowance summary as depicted on Exhibit A. Hardco\er in the 250- <br />500 ’ zone shall not exceed 30%. Applicant is advised that any future requests to <br />increase hardcover or change the nature of cxisting/approved hardcover shall <br />require City approval, and increases in hardcover will not likely be approved <br />without concurrent reduction in existing liar Jeover. <br />2.Authorities granted by this resolution run with the property not with the <br />applicants, but are permissive only and must be exercised by obtaining a building <br />permit for the new construction within one year of the date of Council-approval. <br />Page 3 of 6
